1. TERMS AND CONDITIONS OF SERVICE

Art. 1. General Provisions
1.1. These Terms and Conditions (hereinafter referred to as “T&C”) establish the legal framework for the use of services provided by SC Utopik Carp Lake SRL (hereinafter referred to as “Provider”), headquartered in Oradea, Ion Vidu Street no. 26, through the online platform www.utopikcarplake.ro (hereinafter referred to as the “Website”).
1.2. By accessing, browsing, and using the services available on the Website, the Buyer agrees to fully and unconditionally comply with these T&C, as well as with the Provider’s Rules of Operation and Privacy Policy.
1.3. The terms “Seller” and “Provider” refer to SC Utopik Carp Lake SRL, while “Buyer” and “Client” refer to the natural or legal person purchasing the services.
Art. 2. Purpose and Description of Services
2.1. The object of this contract is the provision of accommodation and recreational fishing services by the Provider to the Buyer, within the lake managed by the Provider.
2.2. The basic services include, but are not limited to:
- (a) Access to the lake premises;
- (b) Access to the accommodation facilities integrated into each fishing stand, including bedroom, bathroom, and relaxation area;
- (c) Access to and use of the fishing stand;
- (d) The right to use the parking area.
2.3. Service prices are displayed on the Website and are expressed in RON, inclusive of VAT. The Provider reserves the right to unilaterally change tariffs, without affecting the value of already confirmed reservations.
Art. 3. Booking and Confirmation Procedure
3.1. Reservations can be made online, up to a maximum of 365 calendar days in advance.
3.2. The Buyer must provide complete, accurate, and up-to-date information in the booking form. Any discrepancy or omission in the information provided is the sole responsibility of the Buyer.
3.3. A reservation is considered confirmed and binding only after the Provider issues a confirmation code to the Buyer’s email address.
3.4. SC Utopik Carp Lake SRL reserves the right to accept or refuse reservations, based on availability, compatibility, and safety criteria.
Art. 4. Payment Method
4.1. Payment for services will be made exclusively through electronic means, namely online by card through the secure platform of the payment processor or by bank transfer.
4.2. The Seller does not store and has no access to the Buyer’s card details; the transaction is processed entirely by the payment processor.
Art. 5. Terms of Use of the Facilities
5.1. Use of the fishing stands and facilities requires compliance with the Internal Regulations for Fishing and Accommodation, available on our Website.
5.2. The fishing schedule is from 00:00 to 24:00, every day.
5.3. The handover of the accommodation facility and fishing stand to the Buyer takes place from 15:00 on the first day of reservation, while their release by the Buyer must take place no later than 10:00 on the last day of the reserved period.
5.4. The minimum booking period is 7 days or multiples of 7 days.
Art. 6. Cancellation, Rescheduling, and Refund Policy
6.1. A cancellation or modification request received less than 30 calendar days before the reserved date results in the full loss of the amount paid. The same applies if the Buyer does not show up on the scheduled date.
6.2. The Buyer is entitled to one rescheduling only, provided that the request is submitted and approved at least 14 calendar days before the initial reservation date. Rescheduling will be made for an available period, established by mutual agreement.
6.3. Cancellation or modification requests must be submitted exclusively in writing, to the email address utopikcarplake@gmail.com, by the reservation holder.
6.4. Requests made through other channels (phone, social media) will not be considered.
Art. 7. Invoicing of Services
7.1. The Seller will issue a fiscal invoice to the Buyer after the amounts related to the reservation have been fully collected into its account.
7.2. The Buyer has the legal obligation to provide all the necessary information for issuing the invoice, in accordance with applicable legislation.
Art. 8. Intellectual Property Rights
8.1. Intellectual Property Rights over the content (including, but not limited to, texts, images, graphics, logos, domain names) belong exclusively to SC Utopik Carp Lake SRL.
8.2. Any use, reproduction, copying, modification, or distribution of the content, trademarks, or graphic elements, without the Provider’s prior written consent, is strictly prohibited and punishable under the law.
8.3. Any infringement will be pursued in accordance with Romanian and European intellectual property law.
Art. 9. Personal Data Confidentiality
9.1. The Provider undertakes to process the Buyer’s personal data in accordance with Regulation (EU) 2016/679 (GDPR).
9.2. By using the Website, the Buyer consents to the processing of their data in accordance with the detailed Privacy Policy available on the Website.
Art. 10. Video Surveillance System
10.1. The Provider uses a video surveillance system (CCTV) to ensure the safety and security of persons, property, and the premises, in accordance with Law no. 333/2003 and Regulation (EU) 2016/679.
10.2. The CCTV system monitors public areas and access points, for the purpose of preventing, deterring, and investigating security incidents.
10.3. Video recordings are stored for a maximum of 2 months and may be made available to the Buyer and/or authorities upon request.
10.4. By accessing the premises, the Buyer understands and accepts that they may be filmed.
10.5. The Provider is not responsible for the safekeeping of personal belongings or vehicles located on the premises, but may provide video recordings to the Client or competent authorities upon request.
Art. 11. Legal Framework of Promotions
11.1. All promotions, offers, and advertising campaigns are valid while stocks last and within the validity period communicated by the Provider.
11.2. The Provider reserves the right to modify, suspend, or cancel any promotion unilaterally and without prior notice, without affecting previously confirmed reservations.
Art. 12. Disclaimer of Warranties
12.1. The services and materials offered on the Website are provided “as is,” without any express or implied warranty, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property rights.
12.2. The Provider does not guarantee the accuracy, completeness, or timeliness of the information on the Website and assumes no obligation to update it, except where required by law.
Art. 13. Limitation of Liability and Assumption of Risk
13.1. The Provider, its representatives, affiliates, or partners shall not be liable for any damages, direct or indirect (including but not limited to loss of profit, data loss, or business interruption), resulting from the use or inability to use the services or the Website.
13.2. The Buyer acknowledges and accepts that fishing activities and presence on the property involve inherent risks (e.g., slippery ground, wet surfaces, natural elements) and fully assumes responsibility for any material damage or bodily injury suffered, regardless of the Provider’s fault.
Art. 14. Force Majeure
14.1. Neither party shall be liable for failure to perform its contractual obligations if such failure is caused by an event of force majeure, defined by law as an unforeseeable event, beyond the control of the parties, and which cannot be avoided.
Art. 15. Governing Law and Jurisdiction
15.1. These T&C are governed by Romanian law.
15.2. Any dispute arising out of or in connection with these T&C shall be settled amicably. If this is not possible, the dispute shall be submitted to the competent courts at the Provider’s registered office.
Art. 16. Assignment of Rights and Obligations
16.1. The Buyer’s rights and obligations under a confirmed reservation are non-transferable. The Buyer may not assign, sell, or transfer the right to use the services to a third party without the Provider’s prior written consent.
Art. 17. Final Provisions
17.1. The Provider reserves the right to unilaterally modify these T&C at any time, with changes taking effect upon publication on the Website.
17.2. Continued use of the Website and the Provider’s services constitutes the Buyer’s express acceptance of the updated T&C.
Art. 18. Electronic Communication
18.1. All communications between the parties (confirmations, notifications, responses, etc.) shall be made electronically, by email or through the booking platform.
18.2. The Buyer is responsible for regularly checking the email address provided for the purpose of receiving notifications.
Art. 19. Personal Data Protection
19.1. UTOPIK CARP LAKE processes the personal data provided by users in accordance with Regulation (EU) 2016/679 (GDPR) on the protection of natural persons regarding the processing of personal data and the free movement of such data.
19.2. The data collected (such as name, email address, phone number, IP address, etc.) are used exclusively for reservations, communication with users, and the transmission of information related to the lake’s activities.
19.3. Users have the right to request access to their data, rectification or deletion thereof, as well as restriction of processing or objection to processing, by submitting a request to the operator’s email address.
19.4. Personal data will not be sold or transferred to third parties, except for service providers necessary for the operation of the Website (e.g., payment processors), who are contractually obliged to maintain the confidentiality of such data.
19.5. By using the Website, the user agrees to the collection and processing of their data under the conditions of this document.
